Drop-Serves

When they don't want to be served...

(A drop-serve is when the server literally DROPS the paperwork in the presence of the servee.)


In Pennsylvania, if a process server confronts somebody that they know is the person that needs to be served, yet the person that needs to be served does not want to cooperate, the process server is permitted to serve the paperwork using a method called the "drop-serve".


Let's say you are trying to serve John Davis. The server has a picture of John Davis which was provided by the client. The server knocks on the door to John Davis's house, and John Davis answers the door.


Process Server: "Hi Sir, I am here to deliver paperwork to a Mr. John Davis."


John Davis: "I don't know who that is, sorry you have the wrong house."


Process Server: "Actually sir, I know you are John Davis, so here you go *extends hand with paperwork to give to Mr. John Davis, who recoils and refuses to take it."

John Davis: "Get off my property! I am not John Davis."


At this point, the process server can drop the paperwork at the feet of Mr. Davis, and later on include the details of service in the affidavit of service which will go to the client/attorney to be filed accordingly.
